Cave Creek, population 5,760 (2018), is located 25 miles north of downtown Phoenix in Maricopa County, Arizona. In 2016, the town adopted a TDR ordinance aimed at consolidating open space into larger contiguous areas suitable for public recreation. In 2018, a code amendment designated the sending area by map.
The ordinance allows receiving sites to satisfy open space requirements by permanently preserving open space at sending sites through conservation easement or development agreement as long as the transfer complies with the general plan and applicable specific plans.
The ordinance allows the town itself to buy transferable rights and hold them for resale. Interjurisdictional transfers are allowed following the signing of an intergovernmental agreement between the town and a county or another municipality.
