Payette County, population 23,951 (2019), lies 50 miles northwest of Boise. The county uses TDR to preserve agricultural land, habitat and open space. Upon the transfer of a development right, the sending site is permanently precluded from receiving TDRs. However, according to Section 8-5-10.F: “This disqualification shall not prohibit any landowner from later applying for a rezone and subdivision approval after fifty (50) years from the approval of any application to transfer a development right.” As of 2009, this program had protected 4,145 acres.
